These Terms for Add-ons and Additional Services apply to all optionally bookable additional services provided by Nexthosting, in particular priority support, the server migration service, managed game servers and plugin/modpack installations.
These Terms supplement the Terms and Conditions, the service description of the respective product, the notice on the right of withdrawal, and the prices and service details displayed during the ordering process. Individual agreements between Nexthosting and the customer take precedence over these Terms.
Add-ons are voluntary additional services. The regular operation of the booked product remains possible without add-ons, unless the respective offer states otherwise.
1. Definitions
The following definitions apply to these Terms:
- Customer: Any natural person or legal entity that orders a product or an additional service from Nexthosting.
- Consumer: A natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
- Entrepreneur: A natural person, legal entity or partnership with legal capacity that, when entering into the contract, acts in the exercise of their commercial or independent professional activity.
- Product: The main product for which an add-on is booked, for example a game server, VPS, web space or a comparable hosting service.
- Add-on: A voluntary, separately bookable service that extends or complements the main product.
- One-time service: An additional service that is performed once and billed once, for example a server migration or a plugin installation.
- Recurring add-on: An additional service that is charged on a regular basis, in particular monthly, in addition to the main product.
- Third-party content: Plugins, mods, modpacks, scripts, resources, frameworks, APIs, licenses, databases, bots, launchers, web interfaces or other content that was not developed or provided by Nexthosting.
- Support hours: The times specified by Nexthosting in the customer area, on the website or in another suitable form during which support requests are processed.
2. Scope and Incorporation
These Terms apply to add-ons if the customer books them during the ordering process, in the customer area, as part of an upgrade, through a subsequent order or through any other express agreement with Nexthosting.
The customer is referred to these Terms during the ordering process or at another suitable point. By completing the order or booking the respective add-on, the customer accepts these Terms as part of the contract.
Where individual add-ons come with their own service descriptions, notices or restrictions during the ordering process, these apply in addition. In the event of conflicts, the following order of precedence applies:
- Individual written agreement with the customer
- Specific service description in the ordering process
- These Terms for Add-ons and Additional Services
- Nexthosting's Terms and Conditions
3. General Terms for Add-ons
Depending on the nature of the service, add-ons may be offered as an additional service billed monthly on a recurring basis or as a one-time setup or service. The prices, terms and service details displayed in the ordering process or the customer area are decisive.
- Recurring add-ons are charged in addition to the price of the main product.
- One-time services are charged once for the performance of the respective service.
- Add-ons apply only to the product for which they were booked.
- A transfer to other products, servers, customer accounts or contractual relationships is only possible with the express consent of Nexthosting.
- Discounts, coupons and promotional prices may be excluded for services if this is indicated in the ordering process.
- Subsequent booking, modification, removal, upgrade or downgrade is only possible to the extent that it is technically and contractually feasible.
Nexthosting is entitled to refuse to perform an additional service or to make it subject to a prior technical review if implementation is technically impossible, violates applicable law, infringes third-party rights, causes security risks, endangers the stable operation of the infrastructure or is obviously outside the booked scope of services.
If Nexthosting refuses an additional service after the order has been placed and the customer is not responsible for the reason for the refusal, fees already paid for the service not performed will be refunded or, at the customer's request, credited to the customer's account.
4. Customer Cooperation Obligations
Many add-ons require the active cooperation of the customer. The customer undertakes to provide all information necessary for performance completely, accurately and in good time.
This includes in particular:
- required server files, backups, access credentials or export data,
- desired configurations, plugin lists, modpack names or installation instructions,
- proof of license for paid third-party content,
- details of the previous server version, game version or software environment,
- relevant error messages, logs or screenshots,
- any other information required for technical implementation.
The customer is responsible for ensuring that the content, files, plugins, mods, scripts, resources, databases and licenses provided may be used lawfully and do not infringe third-party rights.
Delays caused by incomplete, incorrect or late information from the customer extend processing times accordingly. Such delays do not constitute default on the part of Nexthosting.
Before major changes, migrations, installations or configuration work, the customer is obliged to make their own backups of important data, insofar as this is technically possible and reasonable for them. Nexthosting may create backups as a supporting measure where technically possible; however, this creates a comprehensive data backup obligation for customer content only if it has been expressly agreed.
5. Access Credentials, Security and Access to Customer Data
Where access credentials are required to perform an add-on, the customer must transmit them securely. Nexthosting may refuse to accept access credentials sent via insecure communication channels and may require them to be transmitted via a suitable support channel.
Nexthosting accesses server files, configurations, databases, logs or other customer data only to the extent necessary to perform the booked additional service.
The customer is responsible for changing access credentials after the work has been completed, insofar as they have provided Nexthosting with access credentials to external services or third-party systems.
6. Priority Support
With the “Priority Support” add-on, the customer receives preferential placement of their support requests in the internal support queue. The request is reviewed with priority over regular support requests, insofar as this is possible in day-to-day support operations.
Priority support is a prioritization of the processing order, but not a guarantee of a specific response time, resolution time, availability or successful resolution of a problem within a specific period.
6.1 Support tiers
Standard Support
- Included in the regular product price.
- Processed according to time of receipt, workload, severity and internal prioritization.
- Suitable for general questions, normal technical requests and simple assistance.
- No preferential placement over other regular support requests.
Priority Support
- Preferential placement over regular support requests.
- Prioritized review within the available support hours.
- Suitable for customers who want their requests handled more quickly.
- No guaranteed immediate handling and no guaranteed resolution within a fixed period.
Express Support
- Highest prioritization among the optional support add-ons.
- Preferential review ahead of standard and priority support requests, unless more urgent operational, security or outage cases exist.
- Suitable for urgent technical requests.
- No guarantee of an immediate response, permanent availability or successful resolution within a fixed period.
6.2 Limits of priority support
Priority support does not include services that go beyond the agreed support scope of the respective product. The following in particular are not automatically included:
- custom programming, script development or code modifications,
- community management, moderation or player support,
- setup of third-party services outside the Nexthosting infrastructure,
- extensive troubleshooting of third-party plugins, mods or resources,
- legal review of content, licenses or usage rights,
- permanent monitoring of individual customer systems, unless expressly agreed.
Emergencies, security incidents, infrastructure outages, cases of abuse or measures required by law may be given higher priority regardless of the booked support add-on.
7. Server Migration Service
The server migration service assists customers in moving an existing game server to Nexthosting. Depending on the tier booked, Nexthosting handles the transfer of server files, worlds, configurations, plugins, mods, resources or other server-related data.
The server migration service does not include any guarantee that an existing server can be operated on the Nexthosting infrastructure completely, without errors or without the need for adjustments. Technical feasibility depends in particular on the server version, game version, file structure, third-party content, licenses, storage requirements and compatibility.
7.1 Server migration service tiers
I can handle it!
- The customer carries out the migration themselves.
- No transfer is performed by Nexthosting.
- Regular support remains available within the scope of the booked product.
- This option is suitable if no existing server is available or the customer wishes to carry out the migration themselves.
Basic Migration
- Transfer of basic server data of an existing game server.
- Suitable for simple server structures without extensive special configuration.
- Typically includes world files, savegames, basic server folders and simple configuration files.
- Does not include extensive troubleshooting, in-depth plugin/mod adjustments or custom script work.
- Guideline scope: a simple server migration with a manageable file structure and no complex dependencies.
Full Server Migration
- More extensive transfer of an existing game server.
- Suitable for servers with multiple plugins, mods, resources, databases or custom configurations.
- Includes a basic check of whether the server can generally start after the transfer.
- Does not include any guarantee that all third-party content will work without adjustments.
- Complex troubleshooting, database migrations, framework adjustments or script work may require a separate quote.
Express Migration
- Prioritized execution of the server migration ahead of regular migration orders.
- Suitable for customers who want to move their server to Nexthosting as soon as possible.
- Processing begins with priority as soon as all required data is complete.
- A specific completion time is owed only if it has been expressly confirmed in writing.
- Express migration does not guarantee that technical incompatibilities can be resolved more quickly.
7.2 Requirements for the server migration
- The customer must have access to the previous server files, backups or export functions.
- The customer must provide all required files, access credentials, databases or backups.
- The previous provider must technically enable the export.
- The target server at Nexthosting must have sufficient performance, storage space and suitable technical prerequisites.
- Paid plugins, premium resources, scripts, frameworks or licenses must be lawfully acquired and provided by the customer.
- The customer must tell Nexthosting which data must be transferred without fail.
7.3 Limitations of the server migration
- Nexthosting does not guarantee that every existing server can be migrated completely and without functional differences.
- Faulty, outdated or incompatible plugins, mods, resources, scripts or databases may impair the function of the server.
- Custom programming, extensive script adjustments, database cleanups or in-depth error analyses are not automatically included.
- A migration may be refused if content violates applicable law, third-party rights, license terms, game rules, platform terms or Nexthosting's terms of use.
- Nexthosting is not responsible if the previous provider does not provide data completely, provides faulty data or provides no data at all.
8. Managed Game Server
With the “Managed Game Server” add-on, the customer receives additional technical support for their game server. Managed Game Server is aimed at customers who want assistance with configuration, updates, plugins, mods, backups, troubleshooting or minor technical adjustments.
Managed Game Server is a technical support service. It does not include community management, moderation, player support, business consulting, legal review, custom software development, permanent monitoring of individual in-game content or the full operational management of a community project.
8.1 Managed Game Server tiers
Self-Management
- The customer manages the server independently.
- Regular support remains included within the scope of the booked product.
- No additional managed services included.
Managed Basic
- Basic technical support with simple settings and general server questions.
- Support with minor configuration questions.
- Help with simple plugin, mod or server problems where technically possible.
- Up to 1 small change request per billing month included.
- Guideline scope: up to 15 minutes of work per billing month.
- Suitable for small server projects, beginners or simple game servers.
Managed Plus
- All services from Managed Basic.
- Up to 3 small change requests per billing month included.
- Support with plugin and mod configurations within the usual scope.
- Basic performance check in case of problems.
- Support with backup and restore questions.
- Guideline scope: up to 60 minutes of work per billing month.
- Suitable for active communities and growing server projects.
Managed Community
- All services from Managed Plus.
- Up to 5 small change requests per billing month included.
- Extended technical support for server projects.
- Prioritized technical support for more complex requests within the managed scope.
- Support with larger updates after prior arrangement.
- Guideline scope: up to 120 minutes of work per billing month.
- Suitable for RP servers, community servers and larger projects.
8.2 Definition of small change requests
A small change request is a simple technical adjustment that, in Nexthosting's assessment, can be carried out with reasonable effort within the respective managed package.
Small change requests may include, in particular:
- simple configuration changes,
- adjustment of individual server values,
- setup or modification of simple startup parameters,
- minor plugin or mod settings,
- review of simple error messages or logs,
- support with simple backup or restore questions.
The following in particular do not count as small change requests:
- extensive rebuilds of the server,
- custom programming or script development,
- development of custom plugins, mods, bots or web interfaces,
- extensive database work,
- complex error analyses across multiple systems,
- work on external websites, shops, Discord servers or third-party services,
- setup of complete RP, economy, whitelist or community systems,
- design, copywriting, marketing or community management tasks.
If, in Nexthosting's assessment, a task exceeds the included scope, Nexthosting may refuse to carry it out, count it against several change requests or submit an individual quote to the customer. Additional chargeable work is performed only with the customer's prior consent.
8.3 Limitations of Managed Game Server
- Unused change requests expire at the end of the respective billing month.
- Unused change requests are not paid out, credited or transferred.
- Managed Game Server does not include unlimited working time.
- Nexthosting does not guarantee specific player numbers, performance values, revenue, community growth or the permanent freedom from errors of third-party content.
- Custom programming is not included and must be requested separately.
- For very extensive tasks, an individual quote may be required.
- The customer remains responsible for the content, server rules, players, community structure, roles, permissions and legal admissibility of their project.
9. Plugin/Modpack Installation
With the “Plugin/Modpack Installation” add-on, Nexthosting assists with the installation of plugins, mods, modpacks, resources or comparable extensions for game servers.
The installation is performed to the best of our technical judgment on the basis of the information and files provided by the customer. No warranty of functionality is given for third-party content, unless this conflicts with the customer's statutory rights.
9.1 Plugin/Modpack Installation tiers
No Installation
- The customer installs plugins, mods or modpacks themselves.
- No additional setup is performed by Nexthosting.
- Regular support remains available within the scope of the booked product.
Install 1 plugin/mod
- Installation of a single plugin, a single mod or a single resource.
- Suitable for simple extensions with clear installation instructions.
- Includes a basic check of whether the extension has been integrated on the server side.
- Does not include extensive configuration, conflict resolution or customization.
Install up to 5 plugins/mods
- Installation of up to 5 plugins, mods or resources.
- Suitable for smaller server extensions.
- Includes basic integration and simple configuration adjustments as specified by the customer.
- Does not include in-depth troubleshooting, custom adjustments or a compatibility guarantee.
Modpack/Resource Setup
- Setup of a modpack, resource pack or comparable collection.
- Suitable for Minecraft modpacks, FiveM resources, GMod addons or similar systems.
- Includes a basic check of whether the server can generally start after the installation.
- Complex adjustments, conflict resolution, performance optimizations or custom programming are not automatically included.
9.2 Requirements for Plugin/Modpack Installations
- The customer must clearly name the desired plugins, mods, modpacks or resources.
- The customer must provide download sources, proof of license, access credentials or files, where required.
- The extensions must be technically compatible with the booked server product.
- Paid content must be lawfully acquired and provided by the customer.
- The installation must not violate applicable law, third-party rights, license terms, game rules, platform terms or Nexthosting's terms of use.
9.3 Limitations of Plugin/Modpack Installations
- Nexthosting does not guarantee the permanent functionality of third-party extensions.
- Updates to games, server versions, plugins, mods or APIs may impair existing extensions.
- Faulty or outdated extensions may lead to crashes, data loss, security risks or performance problems.
- An in-depth error analysis is included only if this has been expressly agreed.
- Custom adjustments, translations, configurations or programming are not automatically part of the installation.
- Client-side installations on the computer of the customer or the players are not included.
10. Processing Times
The processing time of add-ons depends on the selected service, the technical complexity, the availability of all necessary information, the customer's cooperation and the current workload.
- Prioritized services are processed with priority, insofar as this is technically and organizationally possible.
- A specific processing or completion time applies only if it has been expressly confirmed in writing.
- Delays caused by missing customer data, external providers, third-party software, license problems or technical incompatibilities are outside Nexthosting's area of responsibility.
- Nexthosting may suspend processing for as long as required feedback, files, access credentials or approvals from the customer are missing.
11. Third-Party Content and Licenses
Many game servers use plugins, mods, scripts, resources, frameworks, bots, databases or other content from third parties. The customer is themselves responsible for ensuring that this content may be used lawfully.
- Nexthosting does not provide paid third-party licenses unless expressly agreed.
- The customer must be able to present valid proof of license upon request.
- Nexthosting accepts no responsibility for bans, license problems, API restrictions, update problems or malfunctions of external providers.
- In case of suspected unlawful content, license violations or security risks, Nexthosting may refuse or suspend processing or request that the customer remove the content.
- The customer ensures that the content provided does not infringe any third-party rights.
12. Lawfulness of Content and Misuse
The customer may not use add-ons and additional services to provide, distribute or support unlawful content. This applies in particular to content that violates copyright, trademark rights, personality rights, data protection law, criminal law, youth protection law, license terms or platform terms.
Nexthosting is entitled to refuse to perform or continue an additional service if there are concrete indications of unlawful, abusive, security-endangering or contract-breaching content.
13. Right of Withdrawal for Consumers
In distance contracts, consumers generally have a statutory right of withdrawal in accordance with Nexthosting's respective valid notice on the right of withdrawal, unless the right of withdrawal is excluded by law or has expired.
If a consumer wishes Nexthosting to begin a paid service, in particular a server migration, a plugin/modpack installation, a managed service or any other service, before the withdrawal period has expired, Nexthosting may require the consumer's express consent for this.
In this case, the consumer is informed that, in the event of withdrawal, they may owe compensation for the services already provided up to the time of withdrawal, provided the statutory requirements are met.
In the case of fully performed services, the right of withdrawal may expire before the end of the withdrawal period under the statutory conditions if the consumer has expressly requested that Nexthosting begin the service before the withdrawal period has expired and the consumer has confirmed their awareness of the possible loss of the right of withdrawal.
For digital content or digital services, the statutory provisions on digital products apply. Statutory consumer rights, in particular in the event of defects in digital products, remain unaffected.
14. Upgrades, Downgrades, Cancellation and Term
Recurring add-ons generally run together with the respective main product, unless otherwise stated in the ordering process. When the main product ends, the associated add-on generally ends as well.
- Depending on the billing system, an upgrade may take effect immediately or at the start of the next billing period.
- Depending on the billing system, a downgrade may take effect immediately or at the start of the next billing period.
- In the case of pro-rata billing, the calculation is based on the billing system displayed in the customer area.
- One-time services can be canceled after processing has begun only to the extent permitted by law or with Nexthosting's consent.
- Services that have already been performed in full or in part will be taken into account within the scope of statutory requirements.
- Statutory rights of withdrawal of consumers remain unaffected.
15. Compensation for Additional Work
Services that go beyond the booked scope are not automatically part of the add-on. If Nexthosting determines during processing that a requested service exceeds the booked scope, the customer will be informed.
Additional chargeable work is performed only if the customer has expressly consented to it in advance or accepts an individual quote.
Nexthosting is entitled to suspend further processing until the customer has decided on the continuation, adjustment or ordering of additional services.
16. Warranty Rights and Liability for Defects
Nexthosting provides add-ons and additional services with reasonable care and to the best of its technical judgment. The customer's statutory warranty rights remain unaffected.
A guarantee in the legal sense exists only if Nexthosting expressly designates it in writing as a guarantee. Mere service descriptions, advertising statements or technical assessments do not constitute a guarantee.
For services, Nexthosting generally owes the performance of the agreed activity within the booked scope, but not a specific economic success, a specific number of players, a specific revenue, a specific reach, a specific community development or the permanent functionality of third-party content.
17. Liability
Nexthosting is liable without limitation for damages resulting from injury to life, body or health that are based on a breach of duty by Nexthosting, a legal representative or a vicarious agent. Nexthosting is also liable without limitation for intent and gross negligence and under mandatory statutory liability provisions.
In the event of slightly negligent breach of material contractual obligations, Nexthosting's liability is limited in amount to the typical, foreseeable damage. Material contractual obligations are those obligations whose fulfillment is essential for the proper performance of the contract in the first place and on whose observance the customer may regularly rely.
In all other respects, Nexthosting's liability for slight negligence is excluded, to the extent permitted by law.
For damages, data losses or malfunctions caused by faulty customer data, the customer's own changes, insecure access credentials, unlawful content, incompatible third-party content, external providers, game updates, plugin updates, mod updates or files provided by the customer, Nexthosting is liable only in accordance with the above liability provisions.
Liability under the Product Liability Act and other mandatory statutory liability remains unaffected.
18. Data Backup and Data Loss
The customer remains responsible for backing up their content, configurations, save games, worlds, databases and other data, unless a separate backup service has been expressly agreed.
Nexthosting recommends creating a current backup before any major change, migration, installation or configuration work. Where Nexthosting creates a backup as part of an additional service, this is done as a supporting measure and does not replace the customer's long-term backup strategy, unless one has been expressly agreed by contract.
Data can be restored only if a technically usable backup exists.
19. Changes to These Terms
Nexthosting may amend these Terms with effect for future bookings. For add-ons that have already been booked, the terms that became part of the contract at the time of booking generally continue to apply, unless a permissible contract amendment is agreed or statutory grounds make an adjustment necessary.
20. Relationship to the Terms and Conditions
These Terms supplement Nexthosting's Terms and Conditions. Where these Terms contain no special provision, Nexthosting's Terms and Conditions apply.
In the event of conflicts between these Terms and the Terms and Conditions, the more specific provisions of these add-on terms take precedence, unless the Terms and Conditions expressly provide otherwise.
21. Severability Clause
Should individual provisions of these Terms be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected. The statutory provisions apply in place of the invalid provision.
